An authorised process server is a person or organisation who is compensated for delivering, or “serving”, legal papers and court documents to parties or their legal representatives who are involved in a judicial proceeding. The Procedure We Take
Even though each province has different regulations governing the various methods and times for serving papers, the overall process is the same throughout the country.
1. We Make Duplicates of the Documents that are being served
We will cross-check the copies of the documents against the originals to confirm that they are exactly the same. All parties to be served must get copies, and one copy must be attached to the Affidavit of Service, which we sign as proof of service and retain as a record of our actions.
2. We deliver the documents to the recipients.
Parties involved in the legal action receive the documents that were prepared by the legal team. There are several factors to consider, including who is served, what type of material is being delivered, and where the document is delivered to choose a mode of delivery.
3. We keep a record of the information to serve as a proof of service to the client.
As well as the time, date, and location where the papers were served, we record information on who received the documents such as the person’s driver’s license number in order to identify them later. This information will be included in the Affidavit of Service at a later date.
4. We complete the Proof of Service Form, also known as the Affidavit of Service.
The Affidavit of Service is a certified document that attests to the fact that the papers were properly served to the appropriate party. It is available for purchase from the court or can be seen on the court’s website. When the process server is through with the Affidavit of Service, he or she signs it.
5. Affidavit is attached to the copies of documents that have been served
A separate identification number will be assigned to each document by the process server. If more than one document is served, each document will be identified as Exhibit A, Exhibit B, and so on until the entire case has been served.
6. We Take an Oath of Allegiance
It is necessary to swear or affirm the documents and affidavit in the presence of a commissioner of oaths, a lawyer, or court clerk once they have been signed. The Affidavit of Service, which has been notarised, can be used to demonstrate that the documents were served.
7. Upon request, we provide proof of service to individuals who ask for it
